Many people incorrectly believe that after two years of living with someone you have “common law” rights as husband or wife.
If you are not married or in a civil partnership you will not inherit anything from your partner unless you make a Will. You may also pay more tax.
Alex has no surviving parents or children but has one sibling with whom Alex does not have a good relationship.
Sam’s parents have always treated Alex as part of the family.
If Alex dies all of Alex’s assets (which may include Alex’s share of Alex and Sam’s house) will go to Alex’s sibling. Sam will have to consider making a claim against Alex’s Estate. Such claims are expensive, stressful and time consuming
